Terms and conditions

BraceOctopus provides an integrated security platform for physical sites, cyber estates, and response teams. The public site is https://braceoctopus.co.za. These terms apply to anyone who uses the website, asks for a briefing, or configures a subscription bought through Microsoft Marketplace.

A separate written agreement governs a paid deployment. If that agreement conflicts with these terms, the written agreement applies to that deployment.

The pages on this site describe the platform. Screens on the site show the command view. They are illustrations of the product, not a live operations console and not a promise that every customer estate looks the same.

You may use the site for information about BraceOctopus. You may not misuse it, attempt to break it, or copy it in order to build a competing service.

A briefing request asks us to talk about your sites, systems, and response teams. Sending the form does not create a contract and does not reserve capacity. We will follow up from briefing@braceoctopus.co.za when the request reaches us.

If you buy BraceOctopus through Microsoft Marketplace, Microsoft is the seller for that transaction. Microsoft's Marketplace terms cover purchase, billing, renewal, suspension, and cancellation. These terms cover how you configure and use the BraceOctopus subscription after that purchase.

After purchase, Microsoft sends you to our configure page with a token. We use that token to identify the subscription, show the offer and plan, and activate it when you confirm. Activation is the signal to Microsoft that the subscription can start. Until activation succeeds, Microsoft does not treat the subscription as ready to bill.

Plan changes, quantity changes, suspension, reinstatement, and cancellation are started in Microsoft Marketplace or Microsoft 365 Admin Center. We keep our record of the subscription in step with those events.

You are responsible for the sites, cameras, access systems, networks, and teams you connect, and for having the right to connect them. You will not use the platform to break the law, to watch people without a proper basis, or to interfere with someone else's estate.

We do not promise that the platform will detect every incident, or that a score, status, or timeline is a finding about your business. A technical fault is not a security finding.

The BraceOctopus name, mark, site, and platform remain ours. You keep ownership of your operational data. You give us the right to host and process that data only so we can provide the service you asked for.

The website is provided as it stands. To the extent the law allows, we are not liable for loss arising only from use of the public marketing pages. Liability for a subscribed service is set in the agreement for that service, and is not excluded where South African law does not allow exclusion, including where the Consumer Protection Act 68 of 2008 applies.

These terms are governed by the laws of the Republic of South Africa. Disputes are subject to the courts of South Africa.
